งานเฝ้าดูแลสถานที่หรือทรัพย์สินซึ่งเป็นหน้าที่การทำงานปกติของลูกจ้างมี กฎเฉพาะ สำหรับค่าล่วงเวลาและค่าตอบแทนการทำงานที่เกินวันละ 8 ชั่วโมง โดยวันทำงานจ่ายไม่น้อยกว่า 1.25 เท่าของอัตราค่าจ้างต่อชั่วโมง และวันหยุดจ่ายไม่น้อยกว่า 2.5 เท่าเมื่อเข้าเงื่อนไขของกฎกระทรวง ไม่ควรนำอัตราทั่วไป 1.5/3 เท่ามาใช้แบบเหมารวมกับงานกลุ่มนี้

มาตรา 65 กำหนดงานบางประเภทที่ไม่มีสิทธิค่าล่วงเวลาตามมาตรา 61 และค่าล่วงเวลาในวันหยุดตามมาตรา 63 เช่น ผู้มีอำนาจจริงในการจ้าง ให้บำเหน็จ หรือเลิกจ้าง งานเร่ขายที่รับค่านายหน้า งานรถไฟ งานเปิดปิดประตูน้ำ งานอ่านระดับน้ำ งานดับเพลิง งานนอกสถานที่ที่กำหนดเวลาทำงานแน่นอนไม่ได้ และงานเฝ้าดูแลสถานที่ที่ไม่ใช่งานปกติ ทั้งนี้บางกลุ่มยังมีสิทธิได้รับค่าตอบแทนเป็นเงินเท่ากับอัตราค่าจ้างต่อชั่วโมง
ชื่อเรียกไม่พอ ต้องดูว่ามีอำนาจจ้าง ให้บำเหน็จ หรือเลิกจ้างจริงหรือไม่

กลุ่มที่กฎหมายจำกัดหรือห้าม
- ลูกจ้างอายุต่ำกว่า 18 ปี: ห้ามทำงานล่วงเวลาและทำงานในวันหยุด
- ลูกจ้างหญิงมีครรภ์: โดยหลักห้ามทำงานเวลา 22.00–06.00 น. ทำ OT หรือทำงานวันหยุด เว้นแต่กลุ่มงานที่กฎหมายกำหนดอาจทำ OT ในวันทำงานได้เมื่อยินยอมเป็นคราว ๆ และไม่กระทบสุขภาพ
- งานอันตรายตามกฎกระทรวง: ห้ามทำงานล่วงเวลาหรือทำงานในวันหยุด เว้นแต่ข้อยกเว้นเฉพาะตามกฎหมาย
- กิจการเฉพาะ: ขนส่งทางบก งานบ้าน เกษตร ประมง และงานบางประเภทอาจมีกฎคุ้มครองเฉพาะ ต้องตรวจฉบับที่ใช้กับกิจการนั้น

Start correctly: when work becomes overtime
Overtime is work outside or beyond declared normal working time, or beyond the daily hours agreed under section 23. It does not automatically begin only after eight completed hours. As a rule, the employer must obtain the employee's consent on each occasion before overtime is performed. Exceptions include continuous work that would be damaged by stopping, emergency work, and cases prescribed by law.

Special rule for guarding premises or property from 24 April 2026
Where guarding premises or property is the employee's ordinary duty, a specific ministerial rule governs overtime and compensation for work beyond eight hours a day. Where the rule applies, the minimum is 1.25× on a working day and 2.5× on a holiday. Do not apply the general 1.5×/3× rates to this category without first testing the special rule.

A calculation that can be audited
For a monthly-paid employee, the statutory hourly rate is monthly wages ÷ (30 × average normal working hours per day). The wage base depends on the real nature and purpose of each payment, not its label alone.

The hourly-rate formula assumes eight average normal hours per day. The holiday-work examples deliberately use six hours: the actual boundary follows the employee's declared or agreed normal start/end times or daily hours under section 23, not a universal requirement to complete eight hours first.
Employer view: controls before payroll closes

- Define normal hours, holidays, schedules, and approval authority.
- Use occasion-specific overtime requests recording reason, date, hours, work, and approver.
- Monitor the 36-hour weekly combined limit and required rest.
- Classify working day, holiday, holiday-pay entitlement, and excess hours before choosing a rate.
- Review the statutory wage base and the monthly-wage divisor.
- Reconcile approvals, clock records, schedules, and payroll output.
- Provide payment records showing dates, hours, rates, and amounts.
- Keep time and payment records for at least two years, and longer while a dispute continues.
Exclusions and specially protected groups
Section 65 excludes specified work from sections 61 and 63. Examples include a person with genuine power to hire, reward, or dismiss; certain commissioned travelling sales; railway work; water-gate and water-level work; firefighting; off-site work whose hours cannot be fixed; and non-ordinary guarding work. Some excluded groups remain entitled to hourly-rate compensation. Job title alone never decides the issue.
- Employees under 18 must not work overtime or holidays.
- Pregnant employees are generally restricted from night, overtime, and holiday work, subject to a narrow workday-overtime exception for prescribed roles, consent on each occasion, and no adverse health effect.
- Prescribed hazardous work is subject to stricter limits.
- Transport, domestic, agricultural, fisheries, and other specialised sectors may be governed by specific rules.
Employee view: verify hours and pay systematically

- Retain schedules, clock records, and written instructions or approvals.
- Separate working days from holidays and normal hours from excess hours.
- Check holiday-pay entitlement before choosing the 1× or 2× rate.
- Verify the hourly wage base; monthly wages use 30 × average normal hours per day.
- Compare hours, rate, and amount—not only the total shown on the payslip.
- Raise discrepancies in writing with a calculation table and request an explanation.
Common mistakes
When the amount is wrong
- Prepare a table of dates, hours, day type, rate, wage base, and disputed amount.
- Raise the issue with the manager, HR, or payroll in writing and retain the response.
- Request correction and an auditable payment record.
- If unresolved, consult a labour inspector via 1506 press 3 or 1546, or use the Department's E-Service.
Late payment may attract statutory interest under section 9 and, for intentional default without reasonable cause, an additional statutory amount subject to the legal conditions. Obtain case-specific advice where facts are disputed.
